Virtual Law Office and Client Account/Personal Login Page
Moncarz Law Firm, P.L. provides its clients and potential clients the ability to create a Client Account and access certain attorney-client communications with our office and client documents through a secure personal home page on claudiamoncarz.com. To utilize a Client Account, you must register on claudiamoncarz.com by entering certain personal information and request a username and a unique password. Creating a Client Account does not, in and of itself, establish an attorney/client relationship with Moncarz Law Firm, P.L..
Any information received by Moncarz Law Firm, P.L. through the registration process is held in strict confidence. We do not sell or otherwise disclose to third parties any personal information that you provide through claudiamoncarz.com except as may be required by law or in response to an investigation by law enforcement or other government authorities.
By establishing a Client Account, you acknowledge and agree that in connection with your request for a Client Account, and your use of your Client Account, that you have read and agree to this Terms and Conditions of Use related to claudiamoncarz.com, including use of your Client Account, you have read and understand the security processes that we maintain, and that there are always risks inherent with the transmission, storage, viewing and retrieval of data and files over the internet, including through claudiamoncarz.com. You are solely and fully responsible for the security of your username and password and for any consequences that arise out of your failure to maintain the confidentiality of your username and password. You must notify our office of any unauthorized use of a breach in security of your Client Account. Your right to use your Client Account is personal to you, is for your personal and individual use, and you will not permit any others to use it. Moncarz Law Firm, P.L. reserves the right to suspend, revoke or terminate your use of claudiamoncarz.com and/or your Client Account at any time without notice to you.
Scope of Legal Services
An attorney-client relationship with prospective clients is established only after an attorney of Moncarz Law Firm, P.L. has expressly communicated the ability to accept representation of your matter. Moncarz Law Firm, P.L. may decline to provide legal service if a conflict of interest is discovered. The scope of legal services to be performed by an attorney of Moncarz Law Firm, P.L. will be expressly agreed upon in writing by you before any legal services are performed, and do not include any services that have been expressly excluded or are otherwise outside the scope of the written agreement.
Client Funds
No fee will be charged or obligation incurred by registering on our online law office. In some situations, a client’s funds will not be transferred to Moncarz Law Firm, P.L. until the legal services requested by the client are ready to be accessed and received by the client on their personal login page. However, most requested services require the upfront payment of the agreed upon fee before Moncarz Law Firm, P.L. will begin work. After the client’s payment of the agreed upon price is confirmed through a Cardholder Information Security Program (CISP) compliant credit card processor, the client will have complete access to the legal advice, documents, research or other services provided by the attorney. If further communication with the attorney is required, the client may post a separate question regarding the received legal services or request a price quote for additional legal work.
Termination of Attorney-Client Relationship
An attorney-client relationship with prospective clients is established only after an attorney of Moncarz Law Firm, P.L. has expressly communicated the ability to accept representation of your matter. Once an attorney-client relationship is established in writing, the client has the right to terminate the relationships with or without cause at any time. If the client decides to terminate the attorney-client relationship, the client will only be obligated to pay for the services performed up until the date the cancellation was communicated to our office. Any outstanding funds for services not performed will be refunded to the client within 14 business days.
Cookies
We use session cookies to ensure that your computer displays claudiamoncarz.com effectively. You have the ability to accept or decline cookies using your web browser settings. If you choose not to accept cookies from claudiamoncarz.com, you may not be able to take full advantage of its features or to receive some of the services claudiamoncarz.com provides.

Transactions communicated through our virtual law office application and through your Client Account are conducted over Secure HTTP, which provides you with the highest industry standard protection available on the web. All payments are processed by Cardholder Information Security Program (CISP) complaint credit card processors, and no credit card or payment account numbers are stored on our servers.

Links posted on this website to other websites are provided only as a convenience to our clients. We assume no responsibility for the content, security or reliability of any websites to which we have posted links.

Each person who registers on this website consents irrevocably to personal jurisdiction in such courts with the respect to any matters and waives any defense of forum non conveniens. Furthermore, each person who registers on this website is deemed to have knowingly and voluntarily waived any right to a trial by jury in any case or controversy related to this agreement, claudiamoncarz.com or any services provided by Moncarz Law Firm, P.L..
Assignment
The rights and obligations created for you under this agreement may not be assigned to any other party.
Force Majeure
Moncarz Law Firm, P.L. and any of its attorneys shall not be deemed to be in breach of this agreement for any delay or failure in performance caused by reasons out of its reasonable control, including acts of God or a public enemy; natural calamities; failure of a third party to perform; changes in the laws or regulations; actions of any civil, military or regulatory authority; power outage or other disruptions of communication methods or any other cause which would be out of the reasonable control of Moncarz Law Firm, P.L..
Severance
In the event that one or more of the provisions of this agreement shall be found unenforceable, illegal or invalid, it shall not affect any other provisions of this agreement, and this agreement shall be construed as if the provision found to be unenforceable, illegal or invalid had never been contained in the agreement, or the unenforceable, illegal or invalid provision shall be construed, amended and/or reformed to be made enforceable, legal and valid.
Complete Understanding
These Disclaimers and Terms and Conditions of Use supersedes any prior communication, representations or agreements between you and Moncarz Law Firm, P.L. and constitutes the complete and final agreement related to the use of claudiamoncarz.com or any services provided by Moncarz Law Firm, P.L..
